7.4 – Disposal of Lands Procedures

Standard: The agency shall have established procedures regarding the disposal of park and recreation lands to ensure that public recreational benefits are not diminished through the sale or transfer of parkland.

Suggested Evidence of Compliance:  Provide the procedures for disposal of park and recreation land.

COMMENT: EOC 2 Checklist for Municipalities. This is part of the document in EOC 1 and may not be necessary as a separate EOC.
RESPONSE: Agreed, the checklist for Municipalities Considering Parkland Alienation can be found in The Handbook on the Alienation and Conversion of Municipal Parkland (EOC 1) on pages 30-32. EOC 2 is not needed.

 

 

Narrative:

Disposal of parkland by Westchester County is governed by the State of New York (NYS). Information about the process can be found in the NYS Office of Parks, Recreation and Historic Preservation’s (OPRHP) Handbook on the Alienation or Conversion of Municipal Parkland. 

The Charter of Westchester County, New York: Section 249.111 Sale of property not required for park purposes also provides provisions for the disposal of land. 

The County Executive further issued Executive Order No. 5 of 2019 which locally strengthened policies governing the sale of parkland no longer needed for park purposes.
