5.2.2.1 – Emergency Purchase Procedures

Standard: There shall be established procedures for emergency purchases within the agency to secure equipment or services in a swift and efficient manner.

Suggested Evidence of Compliance: Provide the procedures for emergency purchases.

Narrative:

In order to comply with section 104-B of the New York State (NYS) General Municipal Code, the Westchester County Board of Legislators (BOL) adopted Act 23-1992 to establish a Procurement Policy for Westchester County (WC). Section 10 of that policy provides for accelerated emergency procurements. WC also follows NYS General Municipal Law 103 section 4 which states:

“Notwithstanding the provisions of subdivision one of this section, in the case of a public emergency arising out of an accident or other unforeseen occurrence or condition whereby circumstances affecting public buildings, public property or the life, health, safety or property of the inhabitants of a political subdivision or district therein, require immediate action which cannot await competitive bidding, contracts for public work or the purchase of supplies, material or equipment may be let by the appropriate officer, board or agency of a political subdivision or district therein.”

In addition, WC Bureau of Purchase and Supply (BPS) can make emergency purchases and maintenance repair, rental, or enter into service contracts to remedy breakdown in service or to safeguard life or property without competition. If the purchase exceeds $1,500, BPS must file a complete report to the County Executive.

Key PRC staff are additionally issued credit cards that allow purchases of up to $150 to assist with emergency purchases and rental agreements. Monthly purchasing is limited to $1,000 per card.
