2.10 – ADA Transition Plan

Standard: The agency shall develop and adopt a phased plan for the removal of barriers at existing recreation facilities, parks, and amenities owned or operated by the agency, pursuant to the requirements of the US Department of Justice Title II regulation issued September 14, 2010 and effective March 15, 2011.

Suggested Evidence of Compliance: Submit minutes of the approving authority meeting approving the transition plan, or a copy of the plan noting the dates and times when plan tasks were completed.

COMMENT:  Need: A brief description of any relevant evidence that was included and why it ties to the standard. Considerations to describe include: Was this site plan implemented or when will it be or is it existing? Why it was developed, and amenities selected.
RESPONSE: The facility accessibility assessment surveys (EOC 3) indicate where deficiencies in handicap accessibility are apparent and needed. While there are no timeframes established for addressing these deficiencies, items specified in these surveys are remedied in two ways:

  1. General Maintenance Operations – PRC Maintenance staff will address immediate concerns such as repair and/or replace railings, walkway surfaces, signage, parking lot striping and other ADA-related improvements.
  2. Capital Projects – ADA accessibility concerns are contemplated during the planning of all PRC capital projects. Design plans undergo rigorous review to verify compliance. During construction, inspectors monitor adherence to ADA standards. After completion, projects are assessed for accessibility effectiveness.

COMMENT: Need: The ADA Transition Policy is adopted, was the ADA Transition Plan Adopted (if so, meeting minutes or approval form)?
RESPONSE: Similar to other PRC policy documents, the approval of the ADA Transition Plan rests with the Commissioner of the Department, not with any Board. The current ADA Transition Plan was approved by the Commissioner of Parks, Recreation and Conservation on November 16, 2023. (See EOC 1)

 

Narrative:

The purpose of PRC’s ADA phased transition plan is to provide access to its parks and recreation facilities. PRC conducted its own self-assessment of facilities and has adopted the New York State Office of Parks, Recreation & Historic Preservation’s (OPRHP) ADA Transition Plan as amended and modified to more specifically address needs. The goal is to ensure that there is no discrimination against individuals on the basis of disability in programs and services, and to address and eliminate structural barriers associated with parks and recreation facilities.
